Apostille Processing Time During COVID-19

Due to COVID-19, there may be delays in completing certain documents.

For example, we have seen significant delays in completing FBI background checks through the US Department of State in Washington DC.  We have also experienced significant delays in completing documents from New York and New Jersey.

While most state offices are processing documents fairly quickly, we ask our clients to be patient during these challenging times.  Many of our clients are opting in to have their documents shipped to an international address.  If you have already mailed in your documents for processing and you would like to change the return address to an international address, please let us know ASAP by completing the order status form.  There is an additional fee to ship your documents to an international address.

Certificate of No Record of Marriage Apostille

Do you need a Certificate of No Record of Marriage Apostille?

Note: This document is commonly referred to as a Single Status Affidavit in the United Sates.

If you are planning to get married in another country who is a member of the Hague Apostille Convention, you will be asked to apostille this document.  In some countries, you may also be required to provide this documentation for employment.

This document may also be referred to as the following:

  • No Record of Marriage
  • Certificate of Freedom to Marry
  • Certificate of No Impediment for Marriage
  • Affidavit of Single Status
  • Affidavit of Marriageability
  • Certificate of No Public Record

Here is an example of a single status affidavit you can write yourself.  You can also find some samples online but this is typically what’s required.

Before you write your own Single Status Affidavit and have it notarized, you’ll want to check with the local County Clerk’s office if they can provide you a document that states your single.

The first step is to contact the local County Clerk’s office to request a document that states you are currently not married (AKA: Single Status).  Some County Clerk offices may refer to this document as a “no record of marriage” instead of a “single status” (See list above).  Most all County Clerk offices can provide you this document so please be sure to speak to a supervisor if you are told otherwise.  A document issued from the County Clerk’s office does not require notarization.

If the County Clerk is unable to assist you and you are in the United States, you can use the sample above to write your own single status affidavit.  Basically, you are writing a sworn statement stating that you are currently not married to another person in the United States.  Be sure to have this document signed and notarized before you mail it in to our office. You should also check with the people/country requesting your single status if they will accept a sworn affidavit directly from you.

If you are outside of the United States, the local US Embassy or US Consulate office should be able to assist you in completing a single status and also having it signed and notarized.  Because you will be visiting  U.S. Federal Government office, this document can then only be apostilled through our Washington DC apostille office.

Question: Who can issue the single status affidavit?

Answer: The first step is to contact the local County Clerk’s office to request a document that states you are currently not married (AKA: Single Status).  Some County Clerk offices may refer to this document as a “no record of marriage” instead of a “single status”.  Most all County Clerk offices can provide you this document so please be sure to speak to a supervisor if you are told otherwise.  A document issued from the County Clerk’s office does not require notarization.

Question: How old can my single status affidavit be?

Answer: We recommend that your single status affidavit be recently issued.  Most countries want to make sure you are not married in another country so the date of this document should be within 90 days.  Some countries may even ask for this document to be issued within the past 30 days.  We recommend that you check with the country requesting your document on how old this document can be.

Question: Why do I need to apostille a single status affidavit?

Answer: If you are planning to get married in another country, they want to make sure you are currently not married to another in the country you are from. 

Question: Can I apostille my California single status affidavit in New York?

Answer: No.  A single status affidavit can only receive the apostille from the State of issue.  For example, a single status affidavit issued from Los Angeles County can only receive an apostille from the State of California. Another example is if your single status affidavit was signed and notarized at a U.S. Embassy or U.S. Consulate outside of the USA, this document can only receive an apostille through the U.S. Department of State in Washington D.C.

Question: I am currently outside of the USA, where can I get my single status affidavit?

Answer: Please contact the local U.S. Embassy or U.S. Consulate office near you.  You will need to have a single status affidavit completed and notarized by the U.S. Federal notary who is located there.  Once notarized, mail in this document with our Washington DC apostille order forms to our Washington DC office.

Maryland Circuit Court Authentication and Apostille

Do you need to apostille your notarized documents through the State of Maryland?

Documents signed and notarized in the State of Maryland will also require Clerk of the Circuit Court authentication (AKA Exemplification) before the state will attach the apostille.  Maryland is only a handful of states that still requires notarized documents to be authenticated through the Clerk of the Circuit Court before the State will attach the Maryland apostille.  This is a two-step process.  On the other hand, vital record documents (Example: Birth, death, marriage, etc…) only requires one-step to complete.

The first step is to meet with a local notary public in Maryland.  Once your documents have been signed and notarized, go ahead and mail them in with our Maryland order forms for processing.

Here is an example of a Clerk of the Circuit Court County authentication.  Typically, these certificates have a gold seal and are attached to the page which contains the notary’s seal and signature.

The most popular Circuit Courts we can authenticate documents are from:

  • Anne Arundel County Circuit Court
  • Baltimore County Circuit Court
  • Frederick County Circuit Court
  • Hartford County Circuit Court
  • Montgomery County Circuit court
  • Prince George County Circuit Court

Florida Marriage Certificate Apostille

Do you need to apostille your Florida Marriage Certificate?

In the State of Florida, a marriage certificate is issued by the Clerk of the Circuit and County Courts in the County the marriage was filed in.  In order to apostille this document, you will need to obtain a certified copy signed by the Clerk of the Circuit Court. The certified copy will also have a raised seal (Embossed) and a red stamp from the Circuit and County Courts.  Note: Some County Clerk offices in Florida will use a blue seal.

Here is an example Certificate of Marriage issued by the Miami-Dade County Clerk in Florida….

If you do not have a certified copy, please contact the Clerk of the Circuit and County Courts for instructions on how to obtain a certified copy.  Once you receive the certified copy, go ahead and mail it to our Miami, Florida office for processing with our Florida apostille order forms.  Our office in Florida can apostille all marriage certificates issued from all 67 Counties in Florida.

Documents originating from the State of Florida are processed directly from the Florida Secretary of State’s office. Please note that your documents will receive an Apostille from the State of Florida.

Embassy Legalization Services

Do you need Embassy Legalization Services?

Countries who are not member of the Hague Apostille Convention will require documents to be certified and legalized.   We refer to this process as the Embassy legalization process.   This two or three-step-process is required in order for your documents to be accepted in a foreign country who is not a member of the Hague Apostille Convention.

Whereas the process to apostille a document is one-step, legalizing a document is a multi-step process.  For example, to legalize a California birth certificate for Saudi Arabia, the birth certificate will need to be legalized through the State of California, the U.S. Department of State in Washington, D.C., and the Saudi Arabia Embassy.

Here is an illustration to help explain the process:

Depending on the type of document and it’s origin, the process can be two or three-steps.  Some documents may require additional steps to complete.  Please contact our office so we can provide you the instructions, breakdown in cost, and order forms.
